1. Terms

1.1. This website is operated by SEREINE FASHION S.R.L., a limited liability company, headquartered in Romania, Bucharest, District 2, 9-9A Dimitrie Pompei Boulevard, building no. 2, ground floor, room 1, registered with the Trade Registry attached to the Bucharest Tribunal under no. J40/25057/2022, having Sole Registration Code 47372680, (“SEREINE FINE JEWELRY”). Throughout the site, the terms “we”, “us” and “our” refer to SEREINE. SEREINE offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

1.2. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

1.3. Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to any or all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.

1.4. Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1.5. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

2. Online Store Terms

2.1. By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

2.2. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).  You must not transmit any worms or viruses or any code of a destructive nature.  A breach or violation of any of the Terms will result in an immediate termination of your Services.

3. General Conditions

3.1. We reserve the right to refuse service to anyone for any reason such as frequent returns, etc.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

3.2. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

4. Accuracy, Completeness And Timeliness Of Information

4.1. We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

4.2. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site

4.3. SEREINE does not guarantee that the information entered by website users is real, correct and does not assume responsibility for the way visitors use it, and does not guarantee that the information or Services on the website will satisfy all visitors' requirements.

4.4. We are not responsible for the results obtained by you as a result of using the information or Services on the website; the use of information and Services on the website is at your own risk.

4.5. SEREINE does not guarantee that the Services on the website will work constantly, without interruption, without errors. We are not responsible for any damages that you may have due to the temporary or defective operation of the website or for the use of information obtained by using the links on the website to other sites (their use is at the discretion of the users).

5. Product Prices. Modifications To The Service And Prices

5.1. Prices of the products presented on our website are expressed in RON and are gross prices, i.e. they include taxes, including tax on products and services (VAT).

5.2. The price of each product will be the one mentioned periodically on our website, unless there is an obvious error. Although we take care to ensure that all prices indicated on our website are correct, errors may occur. If we discover a price error with any product(s) in your order, we will inform you as soon as possible and give you the option to reconfirm the order at the correct price or cancel it. If we are unable to contact you for reasons beyond our control, the order will be considered cancelled and, if you have already paid for the product (s), we will refund the full amount paid.

5.3. We have no obligation to sell any product at an incorrectly lower price if the price error is obvious.

5.4. The prices of the products displayed on our website do not include the cost of delivery of the product. The cost of delivery of the ordered product will be given in the order form in each case during the placement of the order, including immediately before and at the moment of the customer's approval and placement of the order, and will be included in the total value of the order. The total order value includes the price of the product and the cost of delivery. The customer will be informed of the total amount of the order including delivery cost each time before placing the order and in the order confirmation email.

5.5. Information on the price of the product, its features and essential characteristics are available in the description of the products in the online store and are provided next to the presented product.

5.6. The prices of products listed on the order form web pages are valid only for placing orders via the order form and may include promotional offers or additional discounts that are updated when the discount code is entered.

5.7. If the customer wishes to receive a VAT invoice, he/she is obliged to provide the tax identification number in the order form. If the customer requests a VAT invoice, the customer agrees that the VAT invoice may be sent to the email address provided by the customer.

5.8. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

6. Products Or Services

6.1. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.  We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.  We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

6.2. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 7. Accuracy Of Billing And Account Information

7.1. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

 7.2. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

8. Optional Tools 

8.1. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

8.2. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

8.3. We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

9. Third-Party Links 

9.1. Certain content, products and services available via our Service may include materials from third-parties.  Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

9.2. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

10. User Comments, Feedback And Other Submissions 

10.1. If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

10.2. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.

10.3. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

12. Errors, Inaccuracies And Omissions

12.1. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

12.2. We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

13. Prohibited Uses

In addition to other prohibitions as set forth in the Terms and Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; (k) to post comments containing personal data such as phone numbers, addresses, e-mail addresses, Personal Identification Number (CNP), series and numbers of the ID cards, or (l) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses. SEREINE does not control, it only supervises the content of the comments/messages posted on the website.

14. Disclaimer Of Warranties; Limitation Of Liability

14.1. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

14.2. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

14.3. In no case shall SEREINE , our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 

15. Indemnification

You agree to indemnify, defend and hold harmless SEREINE and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

16. Rules for the conclusion of the contract

16.1. The customer may place an order, via:

a) placing an order through the order form on the online store website;

b) placing an order through the account filled in with customer's details by filling out the order form to the extent necessary to finalise the order.

16.2. All products and services available in the online store are original, brand new and compliant with generally applicable laws.

16.3. The orders referred to in subsection 1 above may be placed 7 days a week, 24 hours a day.

16.4. Orders placed on weekdays after 04:00 p.m., on Saturdays, Sundays and holidays will be processed the next working day.

16.5. In order to effectively place an order in the manner referred to in 16.1 section a) above, it is necessary to:

a) add the product/service to the cart;

b) correctly fill out the order form available on the website of the online store, containing details for shipment of the product/service;

c) choose the method of payment, the method of delivery;

d) accept the Terms and Conditions and Privacy Policy and press "Order and Pay".

16.6. In order to effectively place the order referred to in 16.1 section b) above, it is necessary to:

a) add the product/service to the cart;

b) log into the account;

c) correctly fill out the order form available on the website of the online store;

d) choose the method of payment, the method of delivery;

e) accept the Terms and Conditions and Privacy Policy and press "Order and Pay".

16.7. SEREINE reserves the right to grant discounts, sales, loyalty points to customers who create an account on the website of the online store. For the avoidance of any doubt, granting these facilities to customers does not constitute an obligation of SEREINE.

16.8. During the process of placing an order, until the button "Order and Pay" is pressed, or until SEREINE confirms that the order placed by the customer is complete, the customer may modify the data entered and change the product/service selection. In order to do so, the customer should follow the messages displayed and the information available on the given SEREINE's webpage.

16.9. Once the order is placed, SEREINE will immediately confirm that the order has been placed by the customer. We confirm the order by sending an email to the customer containing confirmation of all material elements of the order, to the email address provided by the customer.

16.10. The contract will be concluded upon receipt by the customer of the email confirming all material elements of the contract in accordance with subsection 16.9 above.

16.11. The order completion time (completing the order and preparing it for shipping) is between 1 and 7 working days including delivery and is calculated as follows:

a) if the customer chooses payment on delivery – from the date of conclusion of the contract;

b) if the customer chooses electronic payment method – from the date of crediting the seller's bank account with the full amount of the payment.

16.12. The customer may make changes to the order or cancel it until the seller confirms that the order has been placed.

16.13. If the products/services ordered by the customer are not available in the seller's warehouse, the seller will inform accordingly via the online store or inform the customer who placed the order for the product/service. In such case, the customer may agree to extend the completion time of the order or cancel the ordered product/service or the entire order. Adding a product to the shopping cart, without completing the order, does not represent the registration of the order, nor the automatic reservation of the product.

16.14. The customer has to read and accept these Terms and Conditions and the Privacy Policy, as a necessary element of the order placement procedure, which the customer acknowledges by ticking the appropriate box before finalizing the order. The customer's failure to accept these Terms and Conditions or the Privacy Policy in the course of the order placement procedure prevents the possibility of purchasing the product/service via the online store.

16.15. As part of the order placement procedure, the customer also has to provide his/her personal data marked in the order form as obligatory and read the privacy notice regarding the personal data processing available in Privacy Policy. Providing personal data marked as obligatory is voluntary, however, it is necessary to place an order. Providing personal data not marked as obligatory is voluntary and is not necessary to place an order.

16.16. Information on the total value of the order, which includes the price of the product/service, taxes and delivery cost, will be provided in each case on the webpage of the order form when placing the order and then in the order confirmation. Before the order is finalized, the total cost to be paid by the customer, including applicable taxes and delivery cost, will be displayed.

16.17. During the order placement procedure – until the moment of pressing the "Order and Pay" button, the customer may modify the order in the cart, including, without limitation, as regards the selection of the product/service, area and method of delivery of the product/service, method of payment, data provided in the order form.

16.18. The customer places the order by clicking the "Order and Pay" button. An order placed upon clicking “Order and Pay” entails the obligation to pay.

16.19. If the customer has chosen to pay in advance when placing the order, the customer should pay the price and delivery cost of the product/service within 7 days of receiving an email from the seller with confirmation of receipt of the order and acceptance of the order for completion. If the customer fails to make payment within 7 days of order confirmation, the seller will request the customer to make payment. If the payment is not made in full within the period specified in the request, the seller has the right to cancel the order, informing the customer accordingly via email to the customer's email address or by telephone.

If the customer has chosen payment on delivery of the ordered product (cash on delivery) when placing an order, the customer will be obliged to make payment upon delivery of the parcel containing the ordered product. The title to the subject of the order passes to the customer upon payment.

  1. The provision of electronic services by the seller is free of charge.
  2. By completing the order form and completing the payment, the customer assumes his/her liability that all the data provided is correct and complete at the time of purchase.
  3. For situations where the bank issuing the customer's card does not accept payment - in the case of online payment, or the data provided by the customer is incorrect or incomplete, the seller reserves the right to cancel the order. It will issue a notice to the customer and will be exempted from any further obligation.
  4. After completing the order, the seller will issue an invoice to the customer for the delivered products/services, based on the data provided by him/her, according to the legislation in force.

17. Warranties

17.1. All products sold by SEREINE benefit from warranty conditions in accordance with the legislation in force on the territory of Romania.

17.2. The warranty certificate issued by SEREINE, certifies that SEREINE products meet the parameters and quality requirements in accordance with the legal norms in force. The warranty period for gold jeweler is 2 (two) years for any lack of conformity existing at the date of sale.

17.3. The authenticity and characteristics of the precious material - 14K gold (585‰) / 18K gold (750‰) / 24k gold (999.9) - as well as the precious stones inlaid in the jewelry mount are guaranteed for life.

17.4. Other products than those mentioned in subsections 17.2. and 17.3 are guaranteed for 1 year from the date of your purchase.

17.5. The consumer's rights are not affected by the warranty conditions provided in the warranty certificate. With the warranty certificate, we assure you that SEREINE's jewelry is marked in accordance with its own warranty mark and title mark, this being authorized by the National Authority for Consumer Protection - Directorate for Precious Metals. This warranty certificate certifies that the jewel is made of gold.

17.6. For jewels encrusted with stones, in the event of their detachment / falling during the warranty period, the seller will replace them free of charge, within a period of 15 days, only in situations where this is not attributable to the buyer. The warranty does not include damage caused to the jewelry due to non-observance of the indications mentioned in the certificate, normal wear, tear such as bent ring, ear cuff or broken chain, accidents, negligence, improper use or storage or other factors not related to defects in material or workmanship or any modification to your design done by a third party outside of SEREINE.

17.8. Repairs for products under warranty will be carried out free of charge within 15 days, under the conditions provided by art. 12 para. (1) of GEO no. 140/2021, if it is confirmed that a workmanship defect was the cause of such damage.

 18. Transfer of the ownership right

Ownership right of the products will be transferred upon delivery to the address indicated in the order, after payment has been made by the customer. Delivery means the signature of receipt of the transport document provided by the courier or the signature of receipt on the invoice in the case of picking up the products from the seller's physical locations.

 19. Return policy

19.1. If you are not perfectly happy with your purchase, you may return it within 14 calendar days following the delivery date for a refund.

19.2. To initiate a return, please email us at office@sereine.com with your full name and order number as reference.

19.3. For purchases made online, the customer can request the replacement of the purchased product within 14 calendar days, from the date of purchase of the product, with any another product from the store with a value at least equal to the value of the originally purchased product, only on the basis of the fiscal receipt and only if it has not been worn and shows no signs of wear.

19.4. To be eligible for a return, designs must be in new, unused and re-sellable condition, and in their original packaging, and the customer must provide the fiscal receipt. Returns are available only in the store where the product was purchased, in accordance with the provisions of GEO no. 140/2021. Returns must be postmarked within the 14-day return deadline. Returns that do not meet these criteria will not be accepted and will either be sent back to you or a fee will be deducted from your refund to cover the expense of cleaning or repair.

19.5. All designs that are customized at your request are final sale and cannot be returned.

19.6. Shipping for returns is free within Romania.

19.7. The customer will be informed in the order confirmation email whether the purchased products is returnable or not and if there are costs in case of return.

19.8. If the customer chooses a different return method than the one agreed by the seller, the customer is responsible for any packaging and handling irregularities found upon receipt of the return.

19.8. Please note that we are not responsible for returns not received by us if we have not provided you with a return label. In case a return is lost in transit, we will kindly ask you to take the responsibility of locating it.

19.9. Returns that are associated with costs for us upon acceptance are systematically refused.

19.10. Please allow up to 14 business days for your refund to be processed. Original shipping costs and duties, if applicable, will not be refunded.

19.11. We offer 30 day returns for orders placed between Nov. 25th and Dec. 25th.

 20. Exchange policy

20.1. We offer 14-day exchanges for all customers in Romania. Please have your order confirmation email ready. To qualify for an exchange, all items must meet the same return qualifications listed in the Return Policy section.

20.2. In the case of rings whose size can be changed, the customer can request this service within a maximum of 14 days from the date of purchase. The modification procedure is free for all jewelry, except for the case provided in subsection 20.3 below, additional costs being charged only if it is necessary to add material (gold) to increase the diameter of the jewelry. The cost will be calculated according to the weight/quantity of gold added.

20.3. Customized or modified products (special orders, which have been designed or made according to customer preferences) cannot be resized free of charge. The resizing process only applies to resizing the ring. The width or thickness of a ring cannot be changed.

20.4. To return your product for resizing, follow the steps explained in the "Return Policy" section.

20.5. Please avoid having your item resized by a third party, such as another jeweler or person other than SEREINE, as it will void your lifetime warranty.

20.5. The resizing process takes approximately 25 business days, depending on the product, and a resized ring will not be eligible for a refund.

21. Pre-order policy

21.1. Designs available for pre-order appear with the option to “Pre-Order" rather than “Purchase”. The estimated delivery window for each design is located on the product page beneath the description. Please carefully check delivery estimates before placing your order. When purchasing a design available for pre-order, you will be charged immediately. Once your pre-ordered design(s) ship, you will receive a shipping confirmation with tracking information.

21.2. If you have purchased a combination of pre-order and stock designs, your entire order will ship once all designs are complete. This way we limit our shipping emissions. If you would like the stock portion of your order to ship separately, please email us at office@sereine.com for special shipping arrangements.

21.3. Pre-ordered designs are eligible for return within 14 days of receipt. For more information, please refer to our return policy.

22. Shipping policy

22.1. Generally, we ship worldwide. If you do not see your country at checkout, it means that we have not yet opened shipping to your country. Kindly note that we do not ship to PO Boxes, Pack stations, APO or FPO addresses at this time.

22.2. Shipping costs are calculated at checkout and vary depending on your location. We offer complimentary shipping for all international orders above €300.

22.3. All orders ship directly from Romania via DHL (for international orders) and CARGUS (for local orders). Please note that recipients are responsible for all customs duties and taxes, which can be paid upfront at checkout or upon delivery based on your country.

22.4. Delivery time may vary depending on your address location. You will be notified when your package leaves our premises and a tracking number will be sent to the email address you entered when you made your purchase. All parcels are insured during transport.

22.5. If you have not received a tracking number, please also check your spam/junk folder. If you do not know your tracking number, or the delivery status has remained unchanged for several days on the courier company's website, please contact our customer service so that we can investigate the issue for you. In case of any problems, SEREINE remains in touch with the courier company so that they can resolve them quickly and with as little inconvenience as possible for you.

22.6. In the rare case of a lost package or missing design, we will do everything in our power to assist you in the process of locating it. We recommend that you select a delivery address that you trust, and one where someone is available to receive packages on your behalf if you are not around to do so. We are not liable for lost or stolen packages after delivery. If your package has been returned to the dispatcher due to your unavailability at the delivery address, SEREINE reserves the right to charge the customer for the costs of a new delivery.

22.7. If you have provided us with an incorrect delivery address, please notify us as soon as possible. If a package is returned to us due to incorrect delivery details or if it is unclaimed by the recipient, you will be responsible for any re-shipping costs.

22.8. Please check your package before accepting delivery. If the package was damaged during transportation, refuse the delivery receipt and file a claim against the courier company immediately.

23. Severability

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.  

24. Termination

24.1. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

24.2. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

25. Entire Agreement

25.1. The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

25.2. These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions). Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

26. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Romania. Any disputes arising between SEREINE and users / customers will be settled amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts.

You can review the most current version of the Terms and Conditions at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes. 

28. Intellectual Property Right

28.1. The texts and images published by SEREINE on the website are protected by laws regarding intellectual property rights (such as - but not limited to: Law no. 8/1996 on copyright and related rights, Law no. 84/1998 on trademarks and geographical indications). Reproduction of any written or illustrative material of the images and texts is strictly prohibited without the prior consent of SEREINE.

28.2. All materials used on the website are the intellectual property of SEREINE. In the event of copyright infringement, the email address office@sereine.com is available.

28.3. The content, logos, stylized representations, commercial symbols, static images, dynamic images presented on the website are the exclusive property of SEREINE.

28.4. It is forbidden to copy, distribute, publish, transfer, alter, use, any content in any context other than the one originally intended by SEREINE, removing the signs signifying the SEREINE's copyright on the content.
